Acceptable Use Policy

1. Introduction

This Acceptable Use Policy ("AUP") governs your use of Lineserve Cloud services ("Services"). This policy is designed to ensure that our Services remain secure, reliable, and available for all users. By using our Services, you agree to comply with this AUP.

2. General Prohibited Uses

You may not use our Services to:

  • Violate any applicable laws, regulations, or third-party rights
  • Engage in fraudulent, deceptive, or misleading activities
  • Distribute malware, viruses, or other malicious code
  • Attempt to gain unauthorized access to systems or networks
  • Interfere with or disrupt the Services or servers/networks connected to the Services
  • Impersonate any person or entity or misrepresent your affiliation
  • Harvest or collect information about users without their consent

3. Network and Security Abuse

3.1 Prohibited Network Activities

The following activities are strictly prohibited:

  • Port Scanning: Scanning ports on systems without explicit permission
  • Network Probing: Probing, scanning, or testing the vulnerability of any system or network
  • DDoS Attacks: Launching or facilitating distributed denial-of-service attacks
  • Packet Sniffing: Monitoring or intercepting data not intended for you
  • ARP Spoofing: Manipulating network routing or address resolution
  • IP Spoofing: Forging TCP/IP packet headers or any part of the header

3.2 Hacking and Unauthorized Access

You may not:

  • Attempt to breach or circumvent security or authentication measures
  • Access data, systems, or accounts that you do not own or lack authorization to access
  • Test or reverse-engineer the Services to find vulnerabilities (without written permission)
  • Share access credentials or enable unauthorized access to Services
  • Deploy or distribute exploit code, hacking tools, or malicious scripts

4. Spam and Mass Messaging

4.1 Email Spam

You may not use our Services to send:

  • Unsolicited bulk email (spam)
  • Email to recipients who have not opted in to receive it
  • Email without a clear and functional unsubscribe mechanism
  • Email with forged, misleading, or deceptive headers
  • Email that violates CAN-SPAM Act or similar regulations

4.2 Other Forms of Spam

This policy also applies to:

  • SMS/text message spam
  • Social media spam
  • Comment spam on blogs or forums
  • Instant messaging spam
  • API abuse for mass messaging

5. Illegal Content

You may not host, store, transmit, or distribute content that:

  • Infringes intellectual property rights (copyright, trademark, patent, trade secret)
  • Violates privacy or data protection laws
  • Contains child sexual abuse material (CSAM)
  • Promotes or facilitates illegal activities
  • Contains stolen credit card information or financial credentials
  • Violates export control or sanctions regulations
  • Constitutes hate speech, incitement to violence, or harassment

6. Resource Abuse

6.1 Cryptocurrency Mining

Cryptocurrency mining is prohibited on shared and VPS services unless you have obtained explicit written permission from Lineserve. Mining activities consume excessive resources and negatively impact other users on shared infrastructure.

Permitted use cases:

  • Dedicated servers with prior written approval
  • Blockchain development and testing (non-commercial mining)

6.2 Excessive Resource Consumption

You may not:

  • Use resources in a manner that adversely affects other customers or service performance
  • Run processes that consume excessive CPU, memory, disk I/O, or bandwidth without justification
  • Deploy fork bombs, resource exhaustion attacks, or similar abuse
  • Operate proxy servers or VPN services on shared infrastructure (dedicated servers may be permitted)

7. Copyright and DMCA Compliance

Lineserve respects intellectual property rights and expects users to do the same. We comply with the Digital Millennium Copyright Act (DMCA) and similar laws.

7.1 Copyright Infringement

You may not use our Services to:

  • Host or distribute pirated software, media, or other copyrighted content
  • Facilitate copyright infringement through torrent trackers or file-sharing sites
  • Stream or redistribute copyrighted content without proper licensing

7.2 DMCA Notices

If we receive a valid DMCA takedown notice regarding your content, we may remove or disable access to that content. Repeat infringers may have their accounts terminated.

8. Compliance and Legal Requirements

You are responsible for ensuring that your use of our Services complies with:

  • All applicable local, national, and international laws
  • Industry-specific regulations (GDPR, HIPAA, PCI DSS, etc.)
  • Export control and sanctions regulations
  • Data protection and privacy laws in your jurisdiction

If you become aware of any violation of this AUP, please report it immediately:

10.1 Investigation

We reserve the right to investigate suspected violations of this AUP. This may include:

  • Reviewing logs, files, and traffic patterns
  • Temporarily suspending services during investigation
  • Cooperating with law enforcement
  • Gathering evidence for legal proceedings

10.2 Consequences of Violations

Violations of this AUP may result in:

  • Warning: First-time or minor violations may receive a warning with a deadline to remediate
  • Suspension: Temporary suspension of Services until the issue is resolved
  • Termination: Permanent termination of your account and Services
  • Legal Action: Civil or criminal legal action in severe cases
  • No Refund: Violations may result in forfeiture of any prepaid fees

10.3 Immediate Suspension

We may immediately suspend Services without notice if we determine that:

  • Your use poses a security risk to our infrastructure or other users
  • You are engaged in illegal activities
  • Your account has been compromised
  • We receive a valid court order or law enforcement request

11. Customer Responsibility

As a customer, you are responsible for:

  • All activities occurring under your account
  • Securing your servers, applications, and data
  • Ensuring your users comply with this AUP
  • Monitoring and addressing security vulnerabilities
  • Maintaining up-to-date software and security patches
  • Responding promptly to abuse complaints

12. Third-Party Content

If you host or operate services that allow user-generated content, you are responsible for:

  • Implementing content moderation policies
  • Responding to abuse reports in a timely manner
  • Providing tools for users to report violations
  • Ensuring user-generated content complies with this AUP

13. Changes to This Policy

We may update this AUP from time to time. Material changes will be communicated via email at least 15 days before taking effect. Your continued use of Services after changes take effect constitutes acceptance of the revised policy.
