1. Agreement to Terms
By accessing or using Lineserve Cloud services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.
2. Description of Services
Lineserve Cloud provides cloud computing infrastructure services including but not limited to virtual private servers, cloud servers, dedicated servers, storage solutions, managed databases, and Kubernetes clusters.
3. Account Registration
To use our Services, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Be responsible for all activities under your account
4. Acceptable Use
You agree not to use our Services for any unlawful purpose or in any way that could damage, disable, or impair our Services. Prohibited activities include but are not limited to:
- Sending spam or unsolicited communications
- Distributing malware or engaging in hacking activities
- Violating intellectual property rights
- Hosting illegal content
- Cryptocurrency mining without explicit permission
5. Payment and Billing
You agree to pay all fees associated with your use of our Services. Billing terms include:
- Charges are billed according to your selected plan
- Payment is due upon receipt of invoice
- We reserve the right to suspend Services for non-payment
- All fees are non-refundable unless otherwise stated
6. Service Level Agreement
We commit to providing 99.99% uptime for our Services. Service credits may be available for downtime exceeding our SLA commitments. Please refer to our Service Level Agreement for details.
7. Data and Privacy
Your use of our Services is also governed by our Privacy Policy. We collect and use data as described in that policy.
8. Intellectual Property
All content, features, and functionality of our Services are owned by Lineserve and protected by international copyright, trademark, and other intellectual property laws.
9. Termination
We reserve the right to suspend or terminate your account at any time for:
- Violation of these Terms
- Non-payment of fees
- Abuse of our Services
- Request from law enforcement
10. Limitation of Liability
To the maximum extent permitted by law, Lineserve shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses.
11. Warranty Disclaimer
Our Services are provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through our Services. Continued use of Services after changes constitutes acceptance of the modified Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.
